In pursuance to Govt. Memo No. 13380 judl.1/3M-169/64 dt.1-9-55, 1278-Regn. dt 20-12-54 and Registration Directorate. Memo No. 776 dated 26-2-60 and 4312 (12)/13-8-54 the Registering Officers may issue non-encumbrance certificate after searching the relevant regn. records of the last 12 years to the loanees of the (1) Industrial Development Bank (2) House Building Finance Corporation (3) Small and Cottage Industries Corporation and (4) Agriculture Development Finance Corporation (Non Agricultural Bank) to the effect that the properties proposed to be mortgaged are not encumbered, But, it appears that certain Registering Officers issue such certificates after searching only Index Book II and certain other furnish it by searching both Index I and II. As a result, fees being realised vary from office to office. The correct procedure of issuing such certificate to the intending loanees as aforesaid must be formulated to maintain uniformity and realise correct fees to be levied therefore.
You are, therefore, requested to submit detail report on the procedure of issuing such certificates in your district, amount of fees being realized therefore & justification for searching both Indexes I & II or only Index No. II for the purpose of issuing such certificate.
